These terms and conditions of sale are concluded on the one hand by the company PLAYROOM 11 SAS - MYTATTOOFAB with a capital of 1000 euros, whose registered office is located at 31 Avenue de la République 75011 Paris, registered with the Paris Trade and Companies Register under the Siret number 800 120 958 000 15 hereinafter referred to as MyTattoofab.com and on the other hand, by any individual or legal entity wishing to make a purchase via the MyTattoofab.com website, hereinafter referred to as "the buyer".

Subject

The present conditions of sale are intended to define the contractual relationship between Tattoofab.com and the buyer and the conditions applicable to any purchase made through the MyTattoofab.com merchant site, whether the buyer is a professional or a consumer. The acquisition of a good or service through this site implies unreserved acceptance by the buyer of these terms and conditions of sale.

These conditions of sale shall prevail over any other general or special conditions not expressly approved by MyTattoofab.com. MyTattoofab.com reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force at the date of the order by the buyer.

Characteristics of the goods and services offered

The products and services offered are those listed in the catalogue published on the Tattoofab.com website as well as the offer of custom temporary tattoos.

These products and services are offered within the limit of available stocks. Each product is accompanied by a description and visuals. The photographs in the catalogue are as faithful as possible but cannot ensure a perfect similarity with the product offered, particularly with regard to colours.

Prices

The prices appearing in the catalogue are inclusive of all taxes in euros, taking into account the VAT applicable on the day of the order; any change in the rate may be passed on to the price of the products or services. MyTattoofab.com reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include transport and delivery costs provided that they take place in the geographical areas provided for below.

Orders

The buyer, who wishes to purchase a product or service must obligatorily :

- fill in an identification form on which he will indicate all the requested contact details or

- fill in his customer ID if he has one;

- confirm his order after checking it

- Confirmation of the order implies acceptance of the present terms and conditions of sale, the acknowledgement of having perfect knowledge of them and the renunciation to avail oneself of one's own terms and conditions of purchase or other conditions. All the data provided and the recorded confirmation will serve as proof of the transaction. The confirmation will be worth signature and acceptance of the operations carried out. The seller will communicate by e-mail confirmation of the registered order.

Withdrawal

Buyers, non-professional natural persons, benefit from a withdrawal period of seven days from the delivery of their order to return the product to the seller for exchange or refund without penalty, except for the cost of return.

Terms of payment is due at the time of the order for the tattoos in the MyTattoofab.com catalogue.

Payments will be made by credit card; they will be made through the secure systems STRIPE using SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and no third party can read it during transport on the network.

Mytattoofab.com also accepts bank transfers on request.

At the buyer's request, a paper invoice will be sent to the buyer showing the VAT.

Deliveries

Deliveries are made to the address indicated in the order form, which can only be in the agreed geographical area. The risks are borne by the purchaser from the moment the products have left the premises of MyTattoofab.com.

In the event of damage during transport, a reasoned protest must be made to the carrier within three days of delivery. Delivery times are only given as an indication; if they exceed thirty days from the order, the contract of sale may be terminated and the buyer reimbursed.

Warranty

All products supplied by the seller benefit from the legal guarantee provided for in articles 1641 and following of the Civil Code. In case of non-conformity of a product sold, it may be returned to the seller who will take it back, exchange it or refund it. The seller, in the process of selling online, is bound only by an obligation of means; its liability cannot be held liable for any damage resulting from the use of the Internet such as data loss, intrusion, viruses, disruption of service, or other unintended problems. Similarly, users have the right to access and rectify data concerning them, in accordance with the law of January 6, 1978. The automated processing of information, including the management of the e-mail addresses of the site's users has been declared to the CNIL registered under the number 1676603.

Archiving, Proof

Mytattoofab.com will archive purchase orders and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of Article 1348 of the Civil Code. The computerized registers of Mytattoofab.com shall be considered by the parties as proof of communications, orders, payments and transactions between the parties.

Dispute resolution

The present terms and conditions of online sale are subject to French law. In case of dispute, jurisdiction is attributed to the competent courts of Paris, notwithstanding plurality of defendants or appeal in warranty.
